Departments of Transportation and Public Works and the Office of Policy and Management may enter into contracts with the private sector for design-build-finance-operate-maintain or design-build-operate-maintain services involving transportation facilities.

"Transportation facilities" includes roads, airports, seaports, parking facilities, rail facilities, and similar public facilities used for transportation of persons or goods.

State agencies may solicit proposals and consider unsolicited proposals through a competitive sealed proposals procurement process and competitive bidding process.

Department of Transportation shall adopt regulations in consultation with the Department of Public Works and Office of Policy and Management to establish the procurement and bidding processes.

Effective date is October 1, 2011.
