Department of Public Utility Control shall conduct performance reviews of all entities holding certificates for community antenna television service, cable franchise authority, or video franchise authority.

Initial performance review required effective July 1, 2011, with subsequent reviews conducted every five years thereafter.

Performance reviews shall examine customer service, community access support, outage management, service to handicapped and low-income customers, and department cooperation compliance.

Each performance review must be conducted as a contested case with hearing opportunities under state law, with the Attorney General and Office of Consumer Counsel as required parties.

Department may designate applicable advisory councils as intervenors in contested case proceedings.
