Requires local and regional boards of education to evaluate students for special education services "without delay" and in accordance with federal law and regulations, effective July 1, 2011.

Establishes evaluation procedures including use of multiple assessment tools, non-discriminatory testing practices, assessment in all areas of suspected disability, and coordination of evaluations for students transferring between school districts.

Prohibits schools from determining a child requires special education based solely on lack of instruction in reading or mathematics, limited English proficiency, or violations of school disciplinary policies.

Expands the Advisory Council for Special Education from 14 to 17 members by adding representatives from the Office of Protection and Advocacy for Persons with Disabilities, the Parent Leadership Training Institute, and the Bureau of Rehabilitation Services.

Adjusts appointment authority for council members and establishes that members appointed by state department commissioners serve three-year terms while other members serve two-year terms.
