Establishes procedures for the Department of Public Health to create replacement birth certificates for children born through gestational agreements, effective October 1, 2011.

Requires the department to create a replacement certificate immediately upon receipt of a court order approving the gestational agreement and establishing parentage, or upon filing of the original birth certificate if the court order is received before birth.

Specifies that the replacement certificate shall name the intended parent or parents (rather than the birth mother) as the child's parent or parents, while the original certificate is sealed.

Defines "gestational agreement" as a written contract where a woman carries a child for intended parents without contributing genetic material, signed by all parties and witnessed by at least two disinterested adults.

Adds definitions for "gestational agreement" and "intended parent" to the state's vital statistics laws.
