Employers must provide the Workers' Compensation Commission an electronic list by July 1, 2011 of employees injured between July 1, 1993 and May 30, 2006 who received total incapacity compensation reduced due to Social Security old age insurance benefits eligibility and are still receiving such compensation.

Employers or insurers must notify affected employees in writing at their last known address that they may be entitled to increased compensation payments beginning January 1, 2012.

The Workers' Compensation Commission chairman must mail confirmation letters to identified employees on or after October 1, 2011 regarding potential compensation increases, with instructions for those who did not receive employer notice.

By January 1, 2012, the Commission must adjust compensation for eligible employees to the full amount owed without Social Security offset reductions.

Employees receiving adjusted compensation are not eligible for back payments for any compensation received prior to January 2, 2012.
