Effective October 1, 2011, the Department of Environmental Protection cannot modify remediation requirements or standards in a consent order without agreement from both the department and the party involved.

Applies to consent orders concerning one or more parcels of land where remediation is required in whole or in part.

Prevents unilateral changes to remediation standards by the department once a consent order is established.
