Prohibits any person not certified by the Behavior Analyst Certification Board from using the titles "board certified behavior analyst," "certified behavior analyst," "board certified assistant behavior analyst," or "certified assistant behavior analyst" in connection with their name or business.

Prohibits use of the letters "BCBA" or "BCABA" or any words, letters, abbreviations, or insignia implying certification as a board certified behavior analyst or assistant behavior analyst.

Prohibits oral, written, printed, or signed representation (direct or implied) of being a board certified behavior analyst or board certified assistant behavior analyst.

Establishes penalties of a fine not exceeding $500, imprisonment not exceeding 5 years, or both for violations.

Treats each instance of contact or consultation in violation of this section as a separate offense.
