SB 01203 - Water Protection

• Requires state conservation and development plan revisions after December 1, 2011 to consider state water supply policies and a list of water sources requiring protection prepared by the Commissioner of Public Health by October 31, 2011.

• Removes the requirement that bottled water sources be pre-approved by the Department of Public Health, replacing "approved source" language with "supply source" throughout bottled water regulations effective October 1, 2011.

• Eliminates the requirement that bottled water must come from an approved source, allowing bottlers to use any supply source while maintaining compliance with drinking water contaminant standards and quality testing requirements.

• Adds two new criteria for water supply system certificates: proposed systems must not adversely affect nearby water supply systems, and must not be affected by pollution threats deemed adverse to public health by the Department of Public Health.

• Creates new operator certification requirements for water treatment plants, distribution systems, and small water systems, with specified application and renewal fees ranging from $69 to $224, effective October 1, 2011.
