Commissioner of Energy and Environmental Protection may issue a permit for land disposal of solid waste facilities if the applicant provides zoning approval documentation from the municipality or if a council-approved negotiated agreement or arbitration award exists under section 22a-285g

Municipalities retain the right to regulate solid waste facilities through zoning and land usage requirements

Municipal zoning regulations cannot prohibit the construction, alteration, or operation of solid waste facilities within municipality limits
