Electric and gas distribution companies must develop programs allowing residential building owners (1-4 dwelling units) to compare their energy consumption to similar buildings, with proposals due to the Public Utilities Regulatory Authority by January 1, 2013.

Electric and gas companies must maintain and make available energy consumption data for nonresidential buildings (5+ dwelling units) in formats compatible with EPA Energy Star portfolio manager, starting January 1, 2012 for typical buildings and January 1, 2013 for all nonresidential buildings.

Building owners and operators must benchmark energy use and disclose Energy Star ratings when offering nonresidential buildings (50,000+ sq ft) for sale or lease to the state or municipalities by January 1, 2014, with phased timelines for smaller buildings (20,000-50,000 sq ft by July 1, 2014; 10,000-20,000 sq ft by January 1, 2015).

State agencies must benchmark energy use for state-owned nonresidential buildings with at least 10,000 square feet by July 1, 2013, using Energy Star portfolio manager or comparable system.

Owners of residential and nonresidential buildings receiving Energy Efficiency Fund or Clean Energy Fund assistance ($1,000+ for residential; $2,500+ for nonresidential) must benchmark energy consumption before and after assistance and share anonymized data publicly.
