Commissioner of Developmental Services may grant an agricultural conservation easement to a nonprofit organization on land located in Southbury and Roxbury known as the Southbury Training School, subject to State Properties Review Board approval.

Nonprofit organization must be defined under Section 501(c)(3) of the Internal Revenue Code and have a mission to permanently protect agricultural lands for agricultural use.

Nonprofit may lease portions of the easement land to persons for agricultural purposes as defined in state statute.

Easement reverts to Connecticut if the nonprofit fails to use it for agricultural preservation purposes or does not retain ownership of the entire easement.

State retains rights to access the easement land, place and maintain utilities (electrical, water, sanitary, sewer, telecommunications, gas), and exercise other easements necessary for governmental obligations.
