Renames current public indecency offense as "public indecency in the second degree," keeping it a class B misdemeanor with the same conduct requirements (sexual intercourse, lewd exposure, or lewd fondling in a public place)

Creates new offense of "public indecency in the first degree" as a class D felony when the offender commits public indecency in the second degree knowing the conduct will be viewed by a person under 16 years of age

Adds public indecency in the first degree to the list of "criminal offenses against a victim who is a minor," requiring conviction to result in sexual offender registration with the Commissioner of Emergency Services and Public Protection

Effective date for all changes is October 1, 2012
