Medical directors of nursing home facilities may establish prescription drug formulary systems following American Society of Health-System Pharmacists guidelines and collaborative drug therapy management agreements.

Medical directors or their designees must notify the prescribing practitioner before substituting a prescribed drug and cannot proceed if the practitioner objects.

For patients receiving medical assistance benefits, facilities must consider the Department of Social Services preferred drug lists, Medicare Part D formularies, or the patient's health insurance policy when administering drugs.

The provisions became effective October 1, 2012.
