State Ombudsman must create and periodically update a training manual providing guidance on structuring and implementing fear of retaliation training for nursing home facilities to use.

Nursing home administrators must ensure all facility staff receive annual in-service training covering an area specific to patient population needs and residents' fear of retaliation.

In-service training on fear of retaliation must include discussion of residents' rights to file complaints and voice grievances, examples of employee retaliation, and methods to prevent retaliation and alleviate residents' fears.

Commissioner of Public Health shall amend the Public Health Code to align with these training requirements for chronic and convalescent nursing homes and rest homes with nursing supervision.

All provisions become effective October 1, 2012.
