Nursing homes and rest homes with nursing supervision may maintain temperatures below Public Health Code minimums if they comply with federal comfortable and safe temperature standards under 42 CFR 483.15(h)(6), effective October 1, 2012.

The Commissioner of Public Health shall amend the Public Health Code to align with these federal temperature standards for nursing facilities.

If a nursing home cannot comply with the temperature standards due to inadequate facilities, the commissioner may require the owner to sign a consent order with a specified timeline for completing necessary repairs or improvements.

Owners who violate a consent order may be assessed civil penalties of up to $1,000 per day of non-compliance.
