Requires change of ownership applications for nursing homes filed after July 1, 2004 to include a notice in 18-point boldface type warning that licensees, owners, and key personnel may face criminal liability for resident abuse or neglect by employees.

Prohibits the Department of Public Health from approving a nursing home acquisition application for five years if the applicant has three or more civil penalties, significant Medicare/Medicaid sanctions, or termination/non-renewal of provider agreements within two years, unless good cause is shown.

Requires the Department of Public Health to send the liability notice to all existing nursing home licensees by January 1, 2013.

Clarifies that the required notice does not expand or limit existing liability of nursing home owners under law.

Effective October 1, 2012.
