Commissioner of Social Services may make advance payments to nursing facilities providing medical assistance services, not exceeding estimated amounts due over the most recent two-month period, effective July 1, 2012

Advance payments must be recovered through reductions to future payments or cash receipts within ninety days of issuance

Commissioner must take prudent measures to avoid providing advance payments to facilities at risk of bankruptcy or insolvency, and may execute security agreements for repayment

Commissioner shall provide advance payments to facilities upon request when consumers have pending long-term care medical assistance applications for more than one year or when payment has not been made within thirty days of application approval

Advance payments for uncompensated care shall not exceed fifty percent of estimated amounts due and must be recovered within thirty days after application approval and payment
