Establishes the crime of "illegal electronic monitoring" for installing, placing, or using electronic monitoring devices (including GPS and cell phone tracking) to track a person's location without consent, effective October 1, 2012.

Defines "electronic monitoring device" as any electronic or mechanical device that permits remote tracking of a person's position and movement.

Creates exemptions allowing law enforcement officers and state agency employees to use monitoring devices in lawful performance of duties, parents/guardians to track minors, court-authorized guardians/conservators to track their charges, fleet vehicle owners to track their vehicles, and telecommunications providers to disclose tracking in terms of service.

Classifies illegal electronic monitoring as a class A misdemeanor.
