Prohibits smoking in motor vehicles when a child age 6 or younger or weighing less than 60 pounds who requires a child restraint system is present in the vehicle.

Creates a rebuttable presumption that a person holding a cigarette, cigar, pipe, or similar device to or near their mouth while the vehicle is in motion or at rest is presumed to be smoking.

Violations are classified as infractions, except for first-time violations occurring within the first year after the effective date.

First-time violators during the first year after enactment shall receive a written warning instead of an infraction.

Intended to protect children from exposure to secondhand smoke in vehicles.
