State shall indemnify members of special police forces for financial losses and legal expenses arising from civil rights deprivation claims, provided the alleged deprivation was not wanton, reckless, or malicious.

Indemnification applies when officers were acting within the scope of their employment or duties, or under direction of a superior officer at the time of the alleged acts.

State shall cover reasonable legal fees and costs when officers retain attorneys for civil rights deprivation actions if the officer is found not to have acted in a wanton, reckless, or malicious manner.

State shall also cover legal fees and costs if no punitive damages are ultimately assessed against the officer.

Effective date: July 1, 2013.
