Defines "shaken baby syndrome" as brain damage to children three years of age or younger resulting from forceful shaking, including brain swelling that impedes oxygen supply or any degree of brain damage from such shaking.

Establishes that intentionally shaking or causing an infant or young child to be shaken and causing injuries consistent with shaken baby syndrome is a class C felony.

Elevates the offense to a class B felony if death results from the shaking.

Takes effect October 1, 2013.
