Requires insurers, health care centers, hospital service corporations, and medical service corporations to provide annual claims data to public employers with more than 50 employees by October 1st each year, free of charge.

Data must include medical, dental, and pharmaceutical utilization data; claims paid by practice type and service category; premiums paid; number and gender of insureds by coverage tier; and written plan descriptions for all covered populations.

Data covers the most recent 36-month period or entire period of coverage (whichever is shorter) and must be provided in de-identified format compliant with HIPAA regulations.

Employers may use the data only to obtain competitive insurance quotes or promote employee wellness initiatives, and employee organizations designated as exclusive bargaining representatives are entitled to receive the claims information and coverage tier data within 30 days of request.

Information is confidential, not subject to public disclosure, and insurers have standing to challenge subpoenas seeking to compel disclosure in judicial proceedings.
