Department of Public Health, Department of Social Services, and other state agencies must collect and maintain aggregated data (without identifying individuals) on recipients of social services regarding race, ethnicity, sex, sexual orientation, gender identity, primary language, and disability status, effective January 1, 2015.

Agencies may optionally collect additional data including residential address, socioeconomic status, and level of acculturation using self-reporting methods, with parents/guardians authorized to report on behalf of minors or incapacitated persons.

Agencies must conduct annual reviews of collected data to assess demographic characteristics of persons served, including analysis by race, ethnicity, sex, sexual orientation, gender identity, primary language, and disability status.

If an agency cannot collect sufficient data to conduct meaningful analysis, it must establish and implement a plan identifying data collection barriers, solutions to overcome them, and a timeline for achieving effective data collection.
