Persons arrested for misdemeanors or offenses with penalties of not more than one year imprisonment or $1,000 fine must be issued a written complaint and summons and released on their written promise to appear if they present proper identification, without police department processing.

Persons without proper identification may be issued a written complaint and summons at the arresting officer's discretion.

Defines "proper identification" as a valid motor vehicle operator's license, identity card issued under section 1-1h, or U.S. or foreign passport.

Failure to appear on the specified court date subjects the person to warrant issuance for rearrest or capias and penalties under section 53a-173.
