Nonprofit organizations contracting with state agencies under section 4-70b to provide health or human services may retain 100% of revenue exceeding actual expenditures, unless restricted by federal grant requirements.

Revenue retention is permitted only if the nonprofit organization meets the contract's performance requirements and complies with all regulatory requirements and standards established by the contracting state agency.

State agencies must determine within 90 days after each fiscal year whether contracted nonprofit organizations comply with performance and regulatory requirements, and promptly notify the organization of the determination.

Effective date is July 1, 2013.
