Requires nursing home licensees and owners to submit a written change of ownership application prescribed by the Commissioner of Public Health for facilities applying for licensure after July 1, 2004.

Mandates that the first page of the application include a notice statement informing applicants that nursing home licensees, owners, officers, and administrators may be subject to civil, criminal, and administrative liability for resident abuse or neglect by employees.

Requires applicants to disclose whether they have had three or more civil penalties, Medicare/Medicaid sanctions other than those under $20,000, or terminations/non-renewals of provider agreements within the two years preceding application.

Prohibits the Commissioner of Public Health from approving an application to acquire another nursing home for five years from the date of final order on disclosed penalties, sanctions, or terminations/non-renewals, unless good cause is shown.

Clarifies that the required notice statement does not expand or affect existing liability under law for nursing home operators regarding resident abuse or neglect.
