Commissioner of Social Services shall seek a waiver from federal law to establish a Medicaid-financed, home and community-based program for individuals with acquired brain injury, with submission no later than October 1, 1995.

The waiver program shall be operated continuously to the extent permissible under federal law, and services shall not be phased out or result in institutionalization of current recipients to meet federal cost neutrality requirements.

Commissioner may seek approval for a second waiver in addition to the initial waiver for Medicaid-financed, home and community-based services for individuals with acquired brain injury.

Establishes an advisory committee for the second waiver program including legislative chairs and ranking members from human services, public health, and appropriations committees, plus commissioners of Social Services and Mental Health and Addiction Services.

Advisory committee shall meet at least four times per year and submit an initial report by February 1, 2015, on the impact of individual cost caps and other relevant matters to the joint standing committees.
