Manufacturers and out-of-state shippers must deliver timely ordered goods to wholesalers within the month or specified portion of a month when the applicable price was posted and goods were ordered.

If a manufacturer or out-of-state shipper fails to deliver timely ordered goods within the specified timeframe, the manufacturer or shipper must honor the posted price whenever delivery occurs.

Manufacturers and out-of-state shippers are prohibited from delivering goods not affirmatively ordered in writing by the wholesaler or adding unordered quantities to pending orders.

The Department of Consumer Protection may suspend, revoke, or refuse to renew a manufacturer's or out-of-state shipper's permit if they fail to issue a credit to honor posted prices or accept return of unordered goods within 30 days of delivery.

Price posting notices to retail permittees may be given by direct mail, Internet website, or trade publication advertising, with wholesalers also permitted to use hand delivery; effective July 1, 2014.
