Substitute Senate Bill No. 152 Summary

• Allows the Court Support Services Division of the Judicial Branch to access Department of Children and Families records to determine supervision and treatment needs of children and youth in delinquency cases, voluntary services, or custody situations (effective October 1, 2014).

• Permits judges and employees of Probate Court to access juvenile delinquency records in the performance of their duties, and allows information about children subject to court custody orders to be entered into a central computer system for law enforcement and judicial access.

• Expands access to alternative sentencing and community release plans to include employees of the Division of Criminal Justice assigned to relevant court locations and Department of Correction employees.

• Modifies the pretrial drug education program by removing the requirement for a fifteen-session drug intervention program and allowing participants to choose between a fifteen-week drug education program or substance abuse treatment based on court-ordered evaluation.

• Establishes that criminal violation of a protective order issued under family law or protective order statutes is a Class D felony.
