Insurers and health care entities must provide employers with more than 50 employees (towns, cities, school districts, etc.) annual claims data free of charge, including medical/dental/pharmaceutical utilization data, claims paid by service type, premiums, and insured numbers by coverage tier.

Data provision deadline is October 1st annually, covering the most recent 36 months or entire coverage period (whichever is shorter), with data no more than 60 days old.

Employers may use provided information only for obtaining competitive insurance quotes or promoting employee wellness initiatives.

Employee organizations serving as exclusive bargaining representatives can request annual claim information and plan descriptions from employers within 30 days to fulfill collective bargaining duties.

Information is confidential, not subject to public records disclosure, and insurers have legal standing to challenge subpoenas seeking this data in court proceedings.
