HB 5405 Summary

• Repeals and replaces Section 22a-208b of the general statutes, effective July 1, 2015.

• Requires applicants for land disposal solid waste facility permits to provide the Commissioner of Energy and Environmental Protection with proof of local zoning approval, special permits, variances, or other documentation showing municipal compliance.

• Prohibits municipalities from using zoning regulations to ban the construction, alteration, or operation of solid waste facilities within their jurisdiction.

• Requires applicants to obtain all applicable local and municipal approvals and permits before the Commissioner will consider applications for new solid waste facility permits or modified permits to expand existing facilities.
