Foundations established for constituent units or public institutions of higher education are classified as public agencies subject to the Freedom of Information Act, effective October 1, 2015.

Foundations for higher education institutions must have governing boards that include nonvoting representation from the institution's executive authority, elected student representative, and elected faculty representative.

Foundations must maintain generally accepted accounting principles, file annual board member lists with the state agency, and undergo full audits when annual receipts and investment earnings total $100,000 or more.

Written agreements between state agencies and foundations must address facility usage, liability limitations, reimbursement of expenses, investment policies, and procedures for asset disposition if the foundation ceases operations.

Personally identifiable information of donors and prospective donors to higher education foundations is exempt from public disclosure under the Freedom of Information Act without requiring an individual confidentiality request.
