SB 1018 Summary

• Requires state agencies to prepare a "federal deviation analysis" before adopting any proposed regulation that deviates from applicable federal standards or procedures, effective October 1, 2015.

• The federal deviation analysis must explain in plain language the reason for the deviation and be included in the regulation-making record, made publicly available with the notice of proposed regulation, and submitted to the legislative regulation review committee.

• Amends the notice requirements for proposed regulations to reference where interested persons may obtain a copy of the federal deviation analysis if applicable.

• Requires the federal deviation analysis to be included in the regulation-making record maintained by agencies and submitted to the legislative regulation review committee along with other required documents.

• Modifies the submission process to the legislative regulation review committee to include the federal deviation analysis as part of the required materials for regulation approval.
