Prohibits smoking in motor vehicles when a minor (under 18 years old) is present, effective October 1, 2016.

Defines "smoke" or "smoking" as the lighting or carrying of a lighted cigarette, cigar, pipe, or similar device.

Establishes a verbal warning period for violations from October 1, 2016 through September 30, 2017, with violations becoming infractions on and after October 1, 2017.

Specifies that smoking violations in motor vehicles cannot constitute probable cause for law enforcement to search the vehicle or its contents.
