Building permits for one-family dwellings, two-family dwellings, or structures on the same parcel as such dwellings automatically close nine years after issuance if no certificate of occupancy has been issued.

After a permit closes by operation of law, no enforcement action may be initiated based on the permit remaining open.

Municipalities and their officers or employees are granted immunity from liability regarding permits closed under this provision.

"Structure" is defined as any combination of materials affixed to land, including sheds, garages, signs, fences, walls, pools, patios, tennis courts, and decks.

The act takes effect October 1, 2016.
