HB 5498 Summary

• Extends emergency regulation effective periods from 120 days (renewable once for 60 days) to 180 days (renewable once for 60 additional days) for certain marine resource regulations, effective October 1, 2016.

• Adds new categories of technical amendments agencies can make without full notice and hearing procedures, including conforming regulations to statutory amendments, updating contact information, and correcting spelling or formatting errors, effective October 1, 2016.

• Changes the legislative regulation review committee's deadline to approve or disapprove emergency regulations from 10 days to 15 calendar days, with failure to act deemed as approval, effective October 1, 2016.

• Modifies the regulation review cycle for agencies from every five years to every seven years, with committees of cognizance (rather than a single regulation review committee) establishing review dates in consultation with agencies, effective from passage.

• Requires agencies to mail paper copies of regulatory notices to persons who request them on or after October 1, 2016, and enables the public to subscribe to electronic notifications through the eRegulations System, effective January 1, 2017.
