Insurance Commissioner shall convene a working group by October 1, 2015 to develop recommendations for behavioral health utilization and quality measures data to be collected uniformly from state agencies, health insurance plans, and health care companies.

Working group shall consist of the Insurance Commissioner, Healthcare Advocate, Commissioners of Social Services, Public Health, Mental Health and Addiction Services, Children and Families and Developmental Services, Comptroller, and other members deemed necessary.

Working group shall determine data needed to analyze coverage for behavioral health services, medical necessity criteria, provider network adequacy, availability of behavioral health providers, and services for autism spectrum disorders and substance use disorders.

Recommendations may include per member claim expenses, covered treatment lengths by level of care, utilization review data, provider network information, prior authorization request and denial data for behavioral health versus other services, and out-of-network claim payment percentages.

Insurance Commissioner shall submit working group recommendations to Governor and relevant legislative committees by January 1, 2017.
