Repeals and replaces Section 7 of Public Act 15-142 effective July 1, 2016, making permanent the smartphone kill switch requirement.

Defines "smartphone" as a hand-held cellular device with a mobile operating system, software application capability, internet access, text messaging, digital voice service, email capability, and wireless connectivity on long-term evolution or successor networks.

Prohibits retail sale of new smartphone models in the state unless they include software, hardware, or downloadable software that renders essential features inoperable to unauthorized users when initiated by an authorized user.

Removes the previous sunset provision that limited the kill switch requirement to the period between the effective date and July 1, 2017, making the requirement permanent.
