SB 358 Summary

• Establishes definitions for "lottery management service" (purchasing lottery tickets on behalf of others via internet or software application) and "lottery management service company" (person or business providing such services).

• Permits lottery sales agents to enter into agreements with lottery management service companies under specified conditions, including no service fees or credit card charges, age/location verification (18+ and in-state), and allowing customers to view purchased tickets before winning numbers are drawn.

• Requires lottery management service companies to obtain licenses from the Commissioner of Consumer Protection and comply with vendor, affiliate, and occupational licensing requirements.

• Expands Department of Consumer Protection regulatory authority to include licensing and regulation of lottery management service companies alongside existing lottery sales agents.

• Effective date of October 1, 2016 for all amendments to statutes 12-801, 12-568a, 12-813, and 12-815a.
