Creates a civil cause of action for persons injured in person or property to recover damages for emotional distress caused by another's negligent act.

Requires three conditions be met: (1) the negligent person should have realized their conduct involved unreasonable risk of causing emotional distress, (2) the conduct caused emotional distress, and (3) the distress was reasonable given the negligent act.

Awards prevailing plaintiffs damages as determined by the court, with court discretion to also award costs and reasonable attorneys' fees.

Establishes a three-year statute of limitations from the date of the negligent act.

Effective October 1, 2016, and applies only to injuries first sustained on or after that date.
