Records transferred to the state archives that the State Archivist determines to have historical value must be retained permanently, with title vesting in the state archives.

Records in the state archives that are 75 or more years old may be inspected by any person, regardless of confidentiality restrictions in state law.

For records relating to individual persons, access is permitted if either 75 years have passed since the record's creation or 75 years have passed since the subject person's death, whichever is later.

The act takes effect October 1, 2017, and applies to inspection requests made on or after that date.
