Requires paint producers to join a representative organization and submit a paint stewardship program plan to the commissioner by March 1, 2013, focusing on reducing postconsumer paint and promoting reuse and recycling.

Establishes a uniform paint stewardship assessment added to the purchase price of all architectural paint sold in the state, reviewed by an independent auditor to ensure costs do not exceed program expenses.

Limits corporate activity, personnel professional fees, and budgeted state administrative fees to each not exceed 4 percent of total program revenue.

Prohibits producers not participating in the representative organization from selling architectural paint in the state effective with program implementation.

Directs the Department of Energy and Environmental Protection to use budgeted state administrative fees to develop a recycled paint retail sales program selling collected and recycled paint at retail locations.
