Commissioner of Agriculture must adopt regulations by July 1, 2018 to establish an agricultural pilot program for growing and cultivating industrial hemp in compliance with 7 USC 5940.

Only the Department of Agriculture may grow or cultivate industrial hemp through certified and registered sites under the pilot program.

Industrial hemp is defined as Cannabis sativa L. with a delta-9 tetrahydrocannabinol concentration not exceeding 0.3 percent on a dry weight basis.

Commissioner shall review and incorporate relevant provisions from the Kentucky Department of Agriculture Industrial Hemp Research Pilot Program 2017 Policy Guide when developing regulations, as deemed appropriate and consistent with federal law.
