SB 884 Summary

• Adopts the Connecticut Uniform Recognition of Substitute Decision-Making Documents Act, effective October 1, 2017, establishing uniform standards for recognizing powers of attorney and similar documents executed in other jurisdictions.

• Expands agent authority under powers of attorney to include management of digital assets, digital devices, user accounts, and electronically stored information, with agent authorization to change passwords, transfer funds, and access communications within federal privacy law limits.

• Adds intellectual property management to agent powers, allowing agents to register ownership, transfer ownership, grant licenses, and enforce agreements related to copyrights, royalties, and trademarks.

• Removes prior restrictions limiting agent delegation authority; agents may now authorize other persons to exercise granted powers, and requires reinstatement of suspended power of attorney authority upon termination of conservatorship unless court determines otherwise.

• Permits agents to delegate authority granted under powers of attorney and revises statutory short and long forms of durable powers of attorney to reflect expanded powers and updated terminology, effective July 1, 2017.
