HB 5410: An Act Concerning Election Litigation

• Changes venue for all election litigation complaints from any Superior Court location to the superior court for the judicial district of Hartford, effective January 1, 2019.

• Applies to disputes involving state office elections (Governor, Lieutenant Governor, Secretary of State, State Treasurer, Attorney General, State Comptroller, and judges of probate), municipal office elections, and primary elections.

• Maintains existing timelines for filing complaints: 14 days after election/primary for general disputes, or 7 days after manual ballot tabulation closes.

• Preserves complainants' rights to appeal to the Supreme Court and allows judges to reserve questions of law for Supreme Court review.

• Requires complainants to notify the State Elections Enforcement Commission of election litigation by first-class mail or personal delivery.
