Requires local and regional boards of education to enter into written contracts (rather than informal agreements) with private special education providers on or after July 1, 2019, and establishes that individualized education programs do not constitute such contracts.

Mandates that contracts include an explanation of how tuition or service costs are calculated and may require monthly or quarterly service reports and periodic site visits by school boards.

Authorizes the Auditors of Public Accounts to audit private special education providers using a risk-based approach, with priority given to providers receiving the most state or local funds, serving the most students, or having the highest proportion of public funds relative to operational expenses.

Requires the Department of Education to develop standards and documentation processes for private providers to record daily, weekly, and monthly service delivery details including student name, service type, date, duration, and provider signature.

Requires private special education providers to submit their operating budgets to the Department of Education by October 1st of each school year they are providing services.
