HB 5458 - Regulation of Retail Sale of Marijuana

• Allows consumers age 21+ to purchase, possess, and use marijuana and marijuana products, with a possession limit of one ounce (including no more than five grams of marijuana concentrates) effective July 1, 2018.

• Permits individuals age 21+ to cultivate up to six marijuana plants per person for personal use (maximum 12 plants per household) in secure, non-public locations, with seeds sourced from licensed facilities.

• Establishes a Marijuana Control Commission to license and regulate marijuana lounges, retailers, cultivation facilities, product manufacturing facilities, and testing laboratories with standards for security, health, safety, and consumer protection.

• Authorizes individual towns to prohibit or restrict marijuana establishments through ordinance, with the state refusing licenses in non-participating towns or areas with zoning restrictions.

• Exempts licensed marijuana establishments and their employees from criminal liability for possessing, cultivating, manufacturing, testing, and distributing marijuana in compliance with the act's regulations.
