Repeals and replaces subsection (j) of section 17b-342 of the general statutes, effective October 1, 2018.

Allows the Commissioner of Social Services to implement revised criteria for the home-care program while regulations are being adopted, if necessary to conform to federal law requirements.

Requires the commissioner to post notice of the criteria and intent to adopt them on the eRegulations System at least 180 days before implementation (replacing the previous requirement to print notice in the Connecticut Law Journal within 20 days).

Specifies that implemented criteria must be minimally burdensome to affected persons and remain valid until final regulations take effect.

Permits persons aggrieved by or affected by the criteria to bring civil action in Superior Court to challenge their validity and application without first seeking an administrative remedy from the department.
