Commissioner of Agriculture shall establish a memorandum of understanding with aquaculture licensees for the use of electronic surveillance devices to monitor licensee locations and ensure product safety.

Department of Agriculture shall bear all costs associated with the surveillance devices and their services, with funding from the Shellfish Management account and Cross Sound Cable Project account.

Memorandum of understanding shall prohibit disclosure of any data collected from the surveillance devices and remains effective until regulations are adopted.

Department of Agriculture must adopt regulations by July 1, 2020, establishing enforcement criteria for electronic surveillance device requirements, including applicable fees, mandatory fines for violations, and protocols for data storage and safeguarding.
