Health carriers must issue immediate electronic authorization to pharmacies to dispense a temporary drug supply during any grievance or review of an adverse determination for non-controlled prescription drugs, with payment confirmation included.

The temporary drug supply must be sufficient for the duration of the grievance or review process, and the health carrier must confirm provider concurrence within 24 hours or cancel the authorization.

Temporary drug supply authorization does not apply to grievances regarding generic drug substitution or brand name drug substitution unless the prescribing provider specified no substitution.

These requirements apply across all review stages: prospective/concurrent reviews (Section 1), expedited reviews (Section 2), grievance filings (Section 3), and external review processes (Section 4).

All provisions become effective January 1, 2019.
